Terms and Conditions

1. Introduction

Animal Thoughts Limited and it affiliated companies (we, us) owns and operates the website located at the http://www.animalthoughts.com (the Website). We also run workshops and events, and offer consultations, mentoring, training, 1-2-1 sessions and retreats (the Events) for our users.

By using the Site and/or booking Events, you agree to be bound by these terms and conditions (the Terms) together with our privacy and cookie policy. (the Privacy & Cookie Policy). These Terms and the Privacy & Cookie Policy affect your legal rights and obligations so please read them carefully. If you do not agree to be bound by these Terms and/or the Privacy Policy, do not use our Site and/or book an Event.

We reserve the right to update these Terms from time to time at our discretion. We may do so for technical or legal reasons, or because the needs of our business have changed. You agree that if you do not accept any amendment to our Terms then you shall immediately stop accessing and/or using the Site. Amended Terms will be effective as soon as they are accessible, unless the amendment is in our reasonable view significant in which case, amended Terms will be effective 30 days after they are accessible. However, any amendment to the Terms shall not apply to any Event you have already booked. You are responsible for regularly reviewing these Terms so that you are aware of any changes to them. In particular, please read these Terms carefully before booking an Event.

2. Our Content

We provide various content to users, including all content and materials on the Site, such as our free resources and content and materials provided to you as part of or in relation to an Event (Our Content).

The copyright in Our Content is owned by or licensed to us. All rights are reserved. You can view, print or copy Our Content for your own personal use. However, you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, share, commercially exploit, disseminate in any form whatsoever or use Our Content without our permission. If you are interested in any other usage rights in relation to Our Content, please contact us with full details of the usage rights you propose.

We reserve the right to remove any of Our Content from the Site for any reason, without prior notice, and shall have no liability or responsibility to you in any manner whatsoever in such circumstances.

When you use the Site you must comply with all applicable laws. In particular, but without limitation, you agree not to try to gain unauthorised access to the Site or any networks, servers or computer systems connected to the Site and/or reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble all or part of the Site save to the extent expressly permitted by law not capable of lawful exclusion.

It is not necessary to register with us in order to use most parts of the Site. However, if membership areas are created, particular areas of this Site will only be available only if you have registered by inputting your name and your email.

3. Your Content

When you book an Event you provide to us your personal data which we shall process in accordance with our Privacy & Cookie Policy. In addition, you also provide to us information about your animal when you book an Event and/or attend an Event, and depending on the Event you have chosen this may include questions and messages for your animal, your experience and your objections together with a photograph of your animal. In order that we can provide the Event to you to the best of our ability, you agree that all information you provide is accurate and complete.

You also agree that you have the right to provide the photograph to us and/or upload the photograph to the Site and to allow us to reproduce the photograph to carry out the Event. You shall use anti-virus checking software before you upload the photograph to the Site. You shall be liable for any loss that we suffer as a result of your breach of this paragraph.

4. Fees

We do not currently charge users to access our Site. All Fees for Events are clearly set out on the Site, together with payment methods, and may be increased at any time. We do not currently charge VAT.

5. Payment

Membership

Members’ are required to pay for their membership at the time of purchase and then every month there following on the same date each month. We may terminate your membership and remove you from all our Pride platform if your payment fails and we are unable to contact you to collect this. All products and materials within the membership will always remain the property of the business and are not to be reproduced or distributed.

Annual membership to The Pride is on subscription and renews automatically, it is your responsibility to ensure your bank card details are correct and up to date. To do this log in to The Pride portal and click on ‘Your Account’ to update your card.

If we are unable to process your membership payment successfully, our system will usually retry 3 times using the existing payment method you added.  We reserve the right to manually retry this payment(s) at any time on your existing payment method – or any new payment methods that you add to your account – to process any outstanding debts.

Animal Thoughts Ltd is not liable for any late payment fees or reclaimed failed payments by PayPal. For members making their monthly membership payment through PayPal, it is your responsibility to ensure your bank card details are correct and up to date, to do this you can follow the steps on the PayPal site here. Should you cancel your membership with The Pride, it is your responsibility to ensure your recurring payment is cancelled with PayPal directly to save any future payments being taken by PayPal, you can do this with PayPal here.

Please make yourself aware of PayPal’s Privacy Policy if this is your chosen payment gateway for your membership.

Animal Thoughts Ltd does not accept payment in the form of cheques. Consequently, all purchases and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Events

All Events bookings are non-transferable to another person or another course, except in accordance with Condition 11 below. You may not re-sell your booking for an Event.

When you attend an Event you agree to comply with the rules and regulations of the Event venue, and you agree that we shall be entitled to refuse you entry and/or require you to leave the Event if you fail to do so.

You may not film, photograph or otherwise record the Event.

You agree that we may film, photograph or otherwise record your attendance, including any feedback you give to us and use such recordings for any purpose relating to our business including on our Site.

For reasons outside of our control, we may need to change the venue for an Event. We shall contact you by email as soon as we are able to do so in such circumstances with details of the new venue. We shall have no liability to you if we are forced to change the venue, and/or for any failure to host an Event for reasons outside of our control except to refund to you the Fee for the Event.

6. Refund and Cancellation

Refund and cancellation policies depend on the Event or Membership. Each Event or Membership is clearly identified on the Site, but please contact us if you are unsure which you have booked.

Membership

You may cancel your monthly membership at any time by emailing our support team on [email protected] giving 7 DAYS NOTICE to cancel your account.

As a new member, you may cancel your monthly membership and request a full refund within your first 14 days of joining the membership for the first time, this is our money-back guarantee. Outside of your first 14 days, we don’t offer refunds, but you can still cancel your monthly membership at any time.

Existing or returning members, who have joined again, may cancel their membership via the same methods as mentioned above, however, payment will not be eligible for a refund, you will continue to have access to the membership until your cancellation takes effect on the day or so before your next billing date.

For annual subscriptions, you may cancel your membership at any time, meaning it will not renew after the initial 12 months. We do not offer refunds on annual membership subscriptions.

If you have signed up to the monthly membership subscription and would like to switch to an annual membership, our team will be happy to help transfer this for you. Please allow at least 3 days prior to your monthly billing date for us to process the change from a monthly to annual membership in time. Switching from an annual membership to monthly membership is not possible during your first 12 months, however if at the end of your 12 month membership you would prefer to pay monthly instead, our team can happily help you with this.

Consultation – no quibble money back guarantee

If you wish to cancel a consultation after receiving the first impressions, you do not pay a penny. If you decide to continue with the consultation after first impressions, full payment is due at that time and you agree that on receipt of payment we shall then begin to provide the service to you by preparing the complete impressions. You agree that the payment due at that time may be higher than when you first registered on our consultation waiting list.

Workshops

All fees for a workshop are payable in advance. If you wish to cancel and you notify us in writing within 14 days of payment of the fee, we will refund you the amount paid (provided that the workshop has not already taken place). Otherwise no refunds are given for workshops.

Mentoring and VIP-training

All fees for a mentoring session or VIP Training are payable in advance. If you wish to cancel and you notify us in writing within 14 days of payment of the fee, we will refund you the amount paid (provided that the session has not taken place). Otherwise no refunds are given for mentoring session and/or VIP Training. If you are late for a session time cannot be made up. There is scope within the 3 sessions of Mentoring to alter an appointment session because we do understand that sometimes emergencies happen, please check the booking form for precise rescheduling details.

8. Disclaimer – Your attention is particularly drawn to these provisions

We shall prepare Our Content and provide the Events with reasonable skill and care. However, you acknowledge and agree that:

  • Our Content, the Events and animal communication, is not a substitute for trusted veterinarian care and does not offer diagnosis or treatment. We do not diagnose medical issues or offer medical advice. If you have any concerns about your animal’s health you should seek help from a veterinarian or animal health professional.
  • All testimonials were given freely and are deemed to be typical results but are not intended to represent or guarantee that anyone will achieve the same or similar results.
  • Your ability to communicate with your animal depends on a variety of factors, including your background, desire, dedication and motivation. Accordingly, we do not promise that any result or objective will be achieved, be achievable or be attained in whole, in part, or by any given date. This means that you may not see any change in your animal’s behaviour or your ability to communicate with your animal following a workshop, consultation or mentoring.
  • Our Content is therefore for information purposes only. We make no representations as to the accuracy or completeness of Our Content
  • You should behave carefully if any of the Events includes access to animals. You agree that the animals may be nervous within a group setting and you shall take full responsibility for your interactions with animals.
  • We are not liable for any loss, damage or injury you may suffer or for any loss of or damage to your property at an Event including as a result of your interaction with an animal unless, and only to the extent that it was caused by our negligence.

Our maximum liability to you whether in contract, tort or otherwise shall in no circumstances exceed the total Fees paid by you for the Event in question although nothing in these Terms shall be construed as excluding or limiting our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any other liability that cannot be excluded by English law. In addition, your statutory consumer rights are not affected.

9. Links to and from the Site

The Site may contain links to websites or applications operated by third parties. We do not have any influence or control over any such third party websites or applications or the third party operator. We are not responsible for and do not endorse any third party websites or applications or their availability or content.

We accept no responsibility for adverts contained within the Site. If you agree to purchase goods and/or services from any third party who advertises in the Site, you do so at your own risk. The advertiser, and not us, is responsible for such goods and/or services and if you have any questions or complaints in relation to them, you should contact the advertiser.

Any party who wishes to link to this Site is entitled to do so provided that you do not misrepresent your relationship with us and/or this Site for example by suggesting that we endorse your Site; and the website from which you link to this Site does not contain offensive or otherwise controversial content, or content that infringes any intellectual property rights or other rights of a third party.

By linking to this Site in breach of our Terms, you shall indemnify us for any loss or damage we may suffer as a result of such linking.

10. Site Availability

All reasonable measures are taken by us to ensure that this Site is operational every day. However, occasionally technical issues may result in some interruption and accordingly we will not be liable if this Site is unavailable at any time. Where possible we always try to give advance warning of maintenance issues that may result in Site interruption but we shall not be obliged to provide such notice.

For the avoidance of doubt, we shall also not be liable if you are unable to access the Site or any of the Events for any reason within your control, including your failure to use appropriate equipment or insufficient bandwidth.

11. Force Majeure

We are not liable for any loss in excess of the Fee paid if we are unable to run any Event for reasons outside our control, or if our representative running the Event is unable to attend. We shall use all reasonable endeavours to give you as much advanced notice if we are unable to run an Event, and where we are commercially able to do so, we shall offer you an opportunity to transfer your booking to another Event.

 12. Termination

If you breach any provision of these Terms, we may terminate or suspend your attendance and/or access to the Events.

 13. General

 We may choose not to take any action against your failure to comply with these Terms. However, we are still entitled to use our rights in case of subsequent breach of these Terms.

If any provisions of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding the Site and the Events, and supersede and replace any prior agreements we might have between us regarding the Site and the Events.

These Terms shall be governed by and construed in accordance with the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the English Courts.
